TERMS AND CONDITIONS

The undersigned individual (the Participant) hereby indicates their desire to participate in activities operated by Altitude Athletic Training Inc., pursuant to the terms and conditions of this agreement.

 

Health and Safety Attestation:

All of the membership rules contained herein apply equally to members, temporary members and guests alike:

  • The Participant attests that they are fully able to participate in an exercise regimen of their design or choosing without undue risk.
  • The Participant agrees to complete a PARQ form and sign a health and wellness liability waiver prior to training.
  • Participants must be 16 and over to use the Altitude Athletic Training facility unattended without the supervision of an adult.
  • Participants are advised to inform Altitude Athletic Training staff and coaches of any injuries, pains or concerns prior to using equipment and engaging in training.
  • It is necessary that all participants, members and guests of Altitude Athletic Training wear appropriate, clean attire and foot wear when using the amenities and gym, and while participating in activities operated by Altitude Athletic Training.

Gym Rules and Participation:

All of the gym rules contained herein apply equally to participants, members, temporary members and guests alike:

  • The Participant hereby agrees to abide by all posted safety guidelines and regulations while using Altitude Athletic Training’s facilities and equipment. This includes – but is not limited to – changing guidelines regarding Covid-19 precautions.
  • The Participant agrees to dress and conduct themselves in a manner deemed appropriate for a fitness facility.
  • The Participant shall not consume drugs, alcohol, or tobacco products on Altitude Athletic Training’s property.
  • The Participant agrees not to photograph or videotape others without their permission on Altitude Athletic Training’s property.
  • Participants are to use lockers for the period they are at the gym. Lockers will be cleared at the end of the day and all items not collected after a period of two weeks will be donated. Altitude Athletic Training is not responsible for lost or stolen items.

Altitude Athletic Training reserves the right to revoke the Participant’s access if these terms are violated.

MEMBERSHIPs

MEMBERSHIP FEES, RENEWALS AND CHANGES:

Membership Start Dates

All memberships must start within 3 months of purchase date.

Membership Fees and Pricing Changes

Membership fees are subject to economic conditions, inflation, and annual reviews of pricing structures and therefore can be changed at any time; written notification will be provided in the case of price increases to services.

MEMBERSHIP DUES AND AUTOMATIC RENEWAL POLICY:

Monthly memberships will automatically renew each month at the same payment terms and billing date established at time of enrollment. Membership dues may be paid by automatic debit or credit card transaction online, by phone, or in-person. Memberships are nontransferrable and nonrefundable. All prepaid plans (3, 6, and 12 month blocks) are paid upfront and will automatically renew upon expiration at the same rate and terms as the initial membership. Any changes to the plan, or cancellation must be received in advance of the next billing cycle. It is the responsibility of the Participant to monitor membership expiration and renewal dates.

Summit Inaugural Period Pricing End Date and Price Changes on January 5th, 2023 

The membership dues below are valid from the inaugural period between July 16th, 2021 until January 5th, 2023 and are subject to change on January 5th, 2023.

Changes on January 5th, 2023, will not apply to current active members or members on a designated hold period who have not submitted a cancellation request.

Inaugural Summit Members:

  • Will continue at inaugural pricing as long as membership remains active or on an allocated hold period, all dues remain current, and no cancellation request is made.
  • Can renew at inaugural pricing for any term length, assuming the above is true, regardless of prior term length.

Note: Changes may apply to the membership dues of Inaugural Summit Members in the future.

Changes in the membership dues will apply to:

  • New clients purchasing a Summit membership after January 5th, 2023
  • Inactive clients who submitted a cancellation request
  • Clients with overdue membership dues
  • Clients who canceled Summit memberships initially purchased prior to January 5th, 2023, and re-joining after January 5th, 2023
  • Active members on memberships other than Summit choosing to transfer to Summit after January 5th, 2023
  • Active clients on personal training packages or any other service choosing to transfer to Summit after January 5th, 2023

Summit+ Weekly Personal Training Sessions

  • Includes one (1) weekly 60-minute Personal Training session.
  • Session scheduling done directly with the coach or at the front desk.
  • Sessions must be used within the membership term length period.
  • Weekly sessions not used within the term will be lost without any refund and shall not be carried over past the membership renewal or expiry date.
  • Summit+ members must provide at least 24 hours notice prior to cancelling/rescheduling a session.
  • Sessions cancelled over the 24 hours time limit may be rescheduled within the same week but cannot be carried over to following weeks.
  • Sessions cancelled late (before 24 hours) are considered “no-show” and will be missed/cannot be rescheduled

Late policy: If clients are late, the session will be reduced accordingly. If more than 25 minutes late, the coach may choose to cancel the session, and the client may lose that session.

MEMBERSHIP CANCELLATIONS:

General Cancellation Terms:

The Participant agrees to the following membership cancellation policy, which applies to all Altitude memberships.

  • Cancellation Requests:
    • All memberships can be canceled at any time.
    • Cancellation requests must be submitted before the Participant’s renewal date.
    • Submission of requests should be through written confirmation via email to mail@altitudeathletictraining.com.
    • Avoid sending cancellation messages via social media platforms. Phone or in-person confirmations require follow-up with written confirmation via email to mail@altitudeathletictraining.com.
    • No cancellation fees or penalties apply currently.
  • Submission Deadline:
    • All cancellation requests must be submitted and received before the Participant’s renewal date.

Specifics for Summit and Summit+ Memberships:

  • Custom Program Considerations:
    • Summit and Summit+ members follow carefully designed programs created by their coach.
    • Coaches invest time and resources in developing custom programs, preparing future phases based on weekly-monthly blocks.
    • Members are urged to respect coaches’ time and efforts by providing advanced notice before cancellation.

Late Cancellation Policy:

  • Prepaid Plans (3 months, 6 months, 12 months):
    • Cancellation requests submitted after the renewal date are considered late cancellations.
    • In late cancellation circumstances, the Participant will be refunded 50% of the prorated monthly amount on the remaining monthly membership term.
      • For example, if the participant wishes to cancel a 6-month membership, and has used 3 months + 1 week (into their 4 month), they will be refunded 50% of the remaining 2 months.
    • Participants are responsible for providing written notice in advance of their renewal date.
    • Month-to-Month memberships do not apply
  • Prepaid Summit+ Plans (3 months, 6 months, 12 months with additional personal training sessions used):
    • Refund considerations for Summit+ plans are specific.
    • Participants will be refunded 50% of the prorated monthly amount on the remaining monthly membership term.
    • An additional deduction of $150 will be made for every personal training session used beyond one per week.
    • Participants must provide written notice before their renewal date.

Note: The above policies are subject to change, and members are encouraged to stay informed about any updates to the cancellation policy.

MEMBERSHIP HOLDS AND ACCOUNT FREEZES:

General Hold Terms:

The Participant agrees to the following membership hold policy, applicable to Basecamp, Summit, and Summit+ memberships per membership cycle. Members are permitted to freeze or hold their membership for a specified period.

  • Hold Period Requirements:
    • A minimum of 5 days is required to use the hold periods.

Allocated Hold Periods:

The duration of the hold periods varies based on the membership term length. The allocated hold periods for each membership term are as follows:

Membership Extension:

  • All payments drawn before the requested hold will not be refunded.
  • Clients’ memberships will be extended by the number of frozen weeks or months.

Note: It is the responsibility of the Participant to adhere to the minimum notice requirement and communicate any hold requests in a timely manner. Failure to comply may result in the hold request not being processed.

MEMBERSHIP APP ACCESS CODE AND TRAINING PROGRAM ACCESS

Active Membership Requirement:

General Access Terms: This section outlines the requirements for active membership status concerning access to facilities and training programs.

Technogym App Access:

  • Start Date Access:
    • Access to the facility training app for equipment booking, class schedules, etc., is provided only on the official start date of the membership.
  • Eligibility:
    • Exclusive access is granted to current active members of Basecamp, Summit, Summit+, and 60 Colborne.
    • Members of the Altitude Run Club are not included in this access.

Training Program Access (Summit/Summit+ Members):

  • Requirement:
    • To access and benefit from the personalized training program on the Technogym app, members must be active and current.
  • Inactive Status:
    • Members on hold or any other inactive status will not have access to the training program or any services during the hold period.

Membership Downgrade Impact:

If a Participant is a Summit or Summit+ member and chooses to downgrade their membership to Basecamp:

  • Loss of Training Program Access:
    • Members will no longer have access to the training program on the Technogym app upon downgrading to Basecamp.

Note: It is essential for members to maintain active status to enjoy uninterrupted access to the Technogym app and personalized training programs.

MEMBERSHIP LAPSES AND REACTIVATION

If the Participant cancels their membership at any time and returns at a later date they will be subject to any rate increases at the time of enrolment.

REFUNDS

Altitude Athletic Training will not provide refunds retroactively for any cancellation requests. Membership cancellations are processed by sending written notification via email to mail@altitudeathletictraining.com. Please do not send cancellation messages to our Facebook page or other social media sites. Membership cancellations made via phone or in-person must be followed up with written confirmation via email to mail@altitudeathletictraining.com

Altitude Athletic Training does not issue refunds if you do not use your membership.

ASSESSMENTS AND REASSESSMENTS

1. New Summit and Summit+ Memberships: New Summit and Summit+ memberships commence with a comprehensive two-part performance assessment.

2. Reassessment Schedule: Reassessments are conducted after 3 consecutive months of training based on the following schedule:

  • For month-to-month memberships: After the third consecutive month of training (three membership renewals).
  • For 3-month memberships: At the end of the membership term.
  • For 6-month memberships: At 3-months into the membership and at the end of the membership term.
  • For 12-month memberships: At 3-months, 6-months, and at the end of the membership term.

3. Member Reassessment Policy: Members are required to provide a minimum of 24 hours’ notice for any cancellations or rescheduling of quarterly reassessments. Late cancellations (within 24 hours) or no-shows for reassessments will result in the member missing that reassessment for the current cycle.

4. Reassessment Consequences: If a member misses a reassessment due to late cancellation or no-show, they will not be eligible for a rescheduled reassessment within the current cycle.

5. Additional Assessments: Should a member wish to undergo specific assessments, such as the VO2 Max Test or any other A La Carte Assessments, they can purchase these services separately.

6. Membership Term Changes: Switching to a new membership term length after 1 or 2 months of training (e.g., switching to a 6-month term from month-to-month after 1 month of training) does not grant access to an additional two-part performance assessment or reassessment. The reassessment will occur only after three consecutive months of training.

7. Membership Start Requirement: Assessments can only be conducted once the client’s membership has officially started.

8. Results for Summit and Summit+ Members: Assessment results, including InBody Test Results and VO2 max test data, are provided exclusively for Summit and Summit+ members within one week after the Part 2 assessment is complete.

GUEST PASSES

Each active member is entitled to one (1) guest pass per month. Guest passes do not carry over from one month to the next. Unused guest passes for a particular month cannot be saved or accumulated for future use. Members must bring a different guest each time they use their monthly pass.

ALTITUDE MEMBER EQUIPMENT BOOKING POLICY

Booking Platform:

Mywellness App: Members are required to use the Mywellness App for booking equipment/spots in advance.

Booking Timeframe:

  • Availability Window:
    • Bookings open 5 days before the session starts at 12:00 am.
    • Booking closes when the session begins.
  • Booking Increments:
    • Spots are booked in 30-minute increments.

Booking Limits:

  • Maximum Bookings:
    • Members are allowed a maximum of 4 active bookings at any one time.
  • Total Booking Time:
    • Total allowable booking time is capped at 120 minutes.

Waitlist System:

  • Full Equipment/Spots:
    • Equipment/spots with full bookings will have waitlists.
    • Automatic enrollment in the waitlist is available up to 1 hour before the class start time for sessions starting at noon or later.
    • For morning bookings (before noon), automatic enrollment ends at 9 pm the night before.

Cancellation and On-the-Spot Bookings:

  • Cancellation Window:
    • Members can cancel booked sessions up until the session start time.
  • Last-Minute Bookings:
    • Members can book a piece of equipment right before the start time if available spots exist.
  • Drop-In Option:
    • If a member does not sign up in advance, they may drop by the gym before the start time and join if an available spot is open.

Covid-19 Considerations:

  • Advance Booking Encouraged:
    • Due to Covid-19, members are encouraged to book equipment ahead of time to ensure proper staffing and adherence to safety protocols.

DISCOUNTED MEMBERSHIP PLANS AND PACKAGES:

Altitude Athletic Training provides discounted rates to current residents of the 60 Colborne condo building (60 Colborne Street, Toronto, Ontario, M5E 0B7) and families who sign up together (minimum 2 family members). Please inquire with our staff for more details on discounted plans and packages.

THE A TEAM (Available Pre-launch Only):

Pre-Launch Period:

  • Eligibility:
    • The A Team benefits are exclusively for clients who joined during the pre-launch period between June 2019 and July 2021.

Reservation Fee:

  • One-Time Fee:

    • A one-time reservation fee of $100 is applicable at the time of registration.
  • Refundable Option:

    • This fee will be refunded if the member chooses to opt out anytime between registration and one week after Altitude’s launch date.
  • Waiver Option:

    • The fee can be waived if the member prepays for the entire 3 months at $600+HST.

Monthly Membership Fee:

  • Membership Fee:

    • Members agree to pay a monthly membership fee of $200+HST on a month-to-month agreement.
  • Payment Methods:

    • Membership dues may be paid by automatic debit or credit card transaction online, through the phone, or in-person.

Membership Terms:

  • Nontransferrable and Nonrefundable:

    • Memberships are nontransferrable and nonrefundable.
  • Automatic Renewal:

    • The A Team membership automatically renews every month.

FAMILY DISCOUNT

The family discount rate applies for the Basecamp, Summit and Summit+ memberships at Altitude. The discount only applies if 2 or more members of the same family* sign up together on the same membership type and on the same term length (i.e both you and your spouse sign up for 3 months of Summit+ at the same time). Members on the family discount membership shall only renew on the family discount rate if at least one of their fellow family members is an active member at the time of renewal. *A family member is defined as a person in your immediate family or your spouse/partner.

Situation 1 – All other family member(s) put their memberships on a designated hold period

In this situation, the active family members may continue to renew at the family discount rate as long their memberships remain active and the family member(s) on hold follow(s) the designated hold period

Situation 2 – All other family members cancel their membership(s). One family remember remains active

In this situation, the family member continuing on an active membership shall not renew at the family discount rate. Please note this would apply for any cancellation reason including illness or relocation.

PERSONAL TRAINING SESSIONS AND PACKAGES

 Please note that the terms below apply only to personal training clients who have purchased an A La Carte personal training package and do not apply to clients on the Summit+ membership with included weekly personal training sessions.

SESSION BOOKINGS AND CANCELLATIONS:

Session bookings can be made with your personal trainer or at the front desk by phone, email or in-person. All payments must be made in full, either in-person at the front desk or online prior to any sessions being undertaken or booked. 

Personal training sessions can be purchased in packages of 8, 12, 16, 24, 32, 36 or 48 sessions.  If sessions are missed or cancelled, they will carry over and can be rescheduled to another time that is convenient to both the client and trainer before the package expiry date.

All personal training package plans and associated session sets expire after a certain number of months, after which time any unused sessions will be lost and no refund will be made. The expiry schedule is as follows: 

  • 1 Session: expires 30 days from purchase date
  • 8 Sessions: expires 3 months from purchase date
  • 12 Sessions: expires 4 months from purchase date
  • 16 Sessions: expires 5 months from purchase date
  • 24 Sessions: expires 8 months from purchase date
  • 32 Sessions: expires 10 months from purchase date
  • 36 Sessions: expires 11 months from purchase date
  • 48 Sessions: expires 12 months from purchase date

Personal training clients may extend Personal Training packs beyond the expiry day for between one month and 12 full calendar months for the following reasons only:

– Pregnancy
– Serious illness
– Serious injury
– Redundancy
– Relocation

To extend your Personal Training packs you must contact the front desk.

No personal training refunds will be issued for any reason, including but not limited to relocation, illness, and unused sessions.

Personal training clients are encouraged to provide at least 24 hours notice prior to cancelling/rescheduling a session.

LATENESS
  • If your Personal Trainer is more than 15 minutes late for your session you will be entitled to a complimentary session, along with any remaining time you still have for that session.
  • If you are late for your session, your session will be reduced in accordance with that time. If you are more than 25 minutes late, your Personal Trainer may choose to cancel the session and you may lose that session, in which case no refund will be made.
PERSONAL TRAINER
  • If for any reason you are unhappy with your Personal Trainer, you may transfer to another personal trainer at any given time.
  • In all circumstances, any sessions used with the previous Personal Trainer remain used.
  • Your Personal Trainer cannot prescribe treatment or diagnose medical conditions. They may at any time ask to consult with your doctor should any medical condition arise.

A LA CARTE SERVICES (Drop-in Sessions, Class Packages Etc.)

A LA CARTE PAYMENTS AND BOOKING

Nonrecurring payments for A La Carte services and packages are to due prior to the service start date. A la Carte services and packages an be booked online, over the phone or in-person.

Session prices are subject to economic conditions, inflation and annual reviews of pricing structures and therefore can be changed at any time; written notification will be provided in the case of price increases to services.

REFUNDS

A La Carte services and packages are nontransferrable and nonrefundable.

LATE CANCELLATION AND NO-SHOW POLICY FOR A LA CARTE ASSESSMENTS

Cancellation Policy: Clients are required to provide a minimum of 24 hours’ notice for cancellations or rescheduling of VO2 Max Tests, Specific Performance Assessments and all other A La Carte Assessments. Any cancellation made within 24 hours of the scheduled appointment will be considered a late cancellation.

Late Cancellation Consequences:

  1. Late cancellations will result in the forfeiture of the appointment.
  2. Clients will not be eligible for a refund or credit for late cancellations.

No-Show Policy: Clients who fail to appear for a scheduled assessment without any prior notice will be considered a “no-show.”

No-Show Consequences:

  1. No-shows will result in the forfeiture of the appointment.
  2. Clients will not be eligible for a refund or credit for no-show appointments.

Rescheduling Policy:

  1. Clients who wish to reschedule a canceled or missed appointment must do so within a reasonable timeframe.
  2. Rescheduled appointments are subject to availability.

Rescheduling Fee: Clients opting to reschedule a canceled or missed appointment will be required to pay the full price of the original appointment.

Policy Enforcement: This policy will be strictly enforced to ensure fairness to both clients, coaches and our facility. We appreciate your understanding and cooperation in adhering to these guidelines.

CLASSES AND CLASS SCHEDULE

Schedule Changes:

The class schedule provided is subject to change without prior notice. While we strive to maintain the published schedule, unforeseen circumstances may necessitate adjustments.

Minimum Participation Requirement:

Classes require a minimum participation threshold. If fewer than two participants are enrolled in a specific class, the session may be subject to cancellation.

Participant Responsibility:

It is the responsibility of each participant to check for schedule updates regularly. We encourage you to stay informed about any changes that may affect your enrolled classes.

SAFETY, ACCESSIBILITY AND HOURS OF OPERATION

Participant Access:

This agreement entitles the Participant access to Altitude Athletic Training facilities and equipment bookings so long as all dues are current.

 

Specific Entrance:

Altitude Athletic Training is located on the ground level of the 60 Colborne Condo building. Therefore, we must respect the privacy and space of condo residents. All participants must use the front exterior entrance of the facility during operating hours. Altitude Athletic Training has an emergency exit which is to be used by participants in emergencies only.

 

Altitude Chamber Service and Downtime:

Service Interruptions: Altitude Athletic Training reserves the right to switch off the altitude chamber for maintenance, servicing, or other operational reasons at any point. Efforts will be made to provide advance notice to members and participants regarding scheduled service interruptions whenever possible.

Advance Warning: In the event of a scheduled service interruption, Altitude Athletic Training will endeavor to inform members and participants via email, text message, or posted notices within the gym premises. This advance warning will include the date, time, and duration of the service interruption, as well as any alternative arrangements or compensation offered to affected members.

No Liability for Interruptions: Altitude Athletic Training shall not be held liable for any inconvenience, loss of training opportunities, or other damages resulting from service interruptions or downtime of the altitude chamber. Members and participants acknowledge and accept this inherent risk associated with the use of specialized equipment and facilities.

 

Accessibility:

 

All aspects of the Altitude Athletic Training facility are barrier-free and accessible. Please contact an Altitude Athletic Training staff member should you require specific accommodations.

 

Heart Rate Monitor Policy:

 

Heart rate monitors are available for all members, drop-in session clients, personal training clients, and clients undertaking an assessment to use. By using our heart rate monitors, you agree to check them in at the front desk before use and return them upon completion of your workout. If taken home or forgotten, please return them promptly. Failure to return the monitor may incur a $150 replacement fee. Users are responsible for proper handling and reporting any damage. Wear the monitor according to guidelines and assume all associated risks. The facility is not liable for injuries. This policy may be modified at any time.

Hours and specific location access are as follows (and subject to change*):

  • Monday: 6:00 am – 9:00 pm
  • Tuesday: 6:00 am – 9:00 pm
  • Wednesday: 6:00 am – 9:00 pm
  • Thursday: 6:00 am – 9:00 pm
  • Friday: 6:00 am – 9:00 pm
  • Saturday: 7:00 am – 1:00 pm
  • Sunday: 7:00 am – 1:00 pm (sea-level)

*Holiday hours may apply and will be posted on social media and emailed to all members in advance

 

Indemnification:

The Basecamp, Summit and Summit+ memberships and A La Carte Services (Drop-in Packages, Personal Training Packages, Class Packages, etc.) serve as a liability release, pursuant to which the Participant agrees to indemnify and hold Altitude Athletic Training harmless against any and all claims of loss or damage without limitation.

 

Binding Law:

The Basecamp, Summit and Summit+ memberships shall be considered binding upon the Member and Altitude Athletic Training, and shall be upheld and enforced in accordance with the laws of Ontario, Canada. Any legal proceedings related to this gym membership contract shall take place in courts located in Toronto, Ontario, Canada.

 

Acceptance:

The signed parties hereby enter into this contract with one another, in acknowledgement and acceptance of the terms listed above.
